TENS MACHINE HIRE AGREEMENT
By hiring a TENS machine from Birth & Baby (“we”, “our”, “us”), you (“the hirer”, “you”) agree to the following legally binding Hire Agreement. This agreement outlines your responsibilities, our responsibilities, and the conditions of hire.
By confirming your booking with Birth & Baby, you agree to our Terms & Conditions.
In place of a physical signature, any emailed booking confirmation is treated as a binding agreement.
1. Hire Period
The standard hire period is two (2) or four (4) weeks, unless otherwise agreed.
The hire period begins on the date the machine is dispatched or delivered, not the date of first use.
The hire period ends on the agreed return date.
Late returns incur a fee of $12.00 per week (or part thereof), unless prior arrangements have been approved.
2. Booking & Payment
Full payment is required at the time of booking.
Your booking is confirmed only once payment has been received.
3. No Bond Policy
We do not require a bond.
By hiring the equipment, you agree to be financially responsible for any loss, damage, or failure to return the equipment.
4. Delivery & Returns
Local Delivery (Hervey Bay & surrounds)
Free delivery and collection are provided.
Delivery dates are confirmed at the time of booking.
We are not responsible for delays outside our control.
Courier Hires
A prepaid return label is provided.
You must lodge the return parcel on or before the final day of your hire period.
Proof of lodgement may be required.
Late lodgement may result in late fees.
We are not responsible for courier delays once dispatched.
5. Care of Equipment
You agree to:
Use the TENS machine only for its intended purpose.
Not share the unit with others.
Return all components (machine, leads, case, etc.).
Return the machine in clean condition.
Electrode pads are single‑use and do not need to be returned.
6. Cleaning, Hygiene & Maintenance
All machines are cleaned, disinfected, and tested between hires.
We maintain all equipment in accordance with manufacturer specifications and maintenance procedures.
You agree to use the machine hygienically and only on clean, intact skin.
7. Safety Instructions & User Guide Acknowledgement
To comply with insurance requirements, the following applies:

You agree that you understand how to safely operate the TENS machine and will follow all instructions provided.
If unsure, you agree to seek medical advice before use.
8. Medical Disclaimer
You must not use the device:
If you have a pacemaker or certain heart conditions
If you have epilepsy
On broken or irritated skin
Without medical advice if you are unsure
We do not provide medical advice.
Use of the equipment is entirely at your own risk.
9. Loss, Damage or Non‑Return
You are responsible for the equipment for the full hire period.
If the equipment is lost, stolen, not returned, or damaged beyond reasonable wear and tear, you agree to pay:
Replacement cost of the TENS machine (up to $270.00)
Cost of any missing components
10. Cancellations & Refunds
Cancellations made more than 7 days before dispatch: full refund.
Cancellations within 7 days of dispatch: refund not guaranteed.
No refunds once the item has been dispatched.
11. Liability
To the maximum extent permitted by law, Birth & Baby is not liable for:
Any injury, loss, or damage arising from use or misuse of the equipment
Delays caused by third‑party delivery services
The effectiveness or outcome of using the TENS machine
12. Digital Agreement (Tick‑Box Acceptance)
By ticking the agreement box at checkout, you confirm that:
You have read and agree to this Hire Agreement
You have received and understood the Safety Instructions
You have received the Manufacturer’s User Guide for your device
You accept responsibility for the safe and appropriate use of the equipment
This digital acknowledgement is legally binding and serves as your signed hire agreement, meeting insurance requirements.
